We are in the midst of the hurricane season and we have just had our first storm of the year that posed a threat to Florida.  This is a good reminder to take a look at your homeowner’s insurance policy to make sure you have appropriate coverage and none of your information – such as residents of the household or pets – needs updated.  While you are at it, it is probably a good idea to look at your other insurance policies also.

Why is it so important to update your insurance policies with new information?  Insurance companies can deny coverage for a loss when there is a “material misrepresentation” by the insured when procuring the policy.  As indicated above, these material misrepresentations can be in the form of a failure to disclose a resident relative or a new pet.  This can be devastating for someone who has faithfully paid their premiums for years because it may mean you have no insurance coverage for an event that destroys your home or where you are involved in car crash or other incident where you cause another person bodily injury and
property damage.

Whether it is coverage for your home, coverage for the contents within your home, bodily injury coverage for your motor vehicle, or underinsured motorist coverage for your vehicle– you should also regularly check to see if you have enough coverage.   We regularly see Defendants that cause motor vehicle crashes who do not update their auto policies with increases in their earnings so they do not have enough coverage.  When this is the case, then they leave assets unprotected.   Also, we often see clients who carry minimal or no underinsured motorist coverage.  Many of them don’t even know that they have selected reduced or no underinsured motorist coverage because they simply check a box on the application for insurance because their agent tells them it is a way to reduce their premium.  The results can leave a client with little or no recovery after sustaining serious injuries in a car crash.
